General Conditions

These general conditions of sale apply to any order placed on the website www.cegoceramiche.com owned by Pernigotto s.r.l.

The buyer's "Order Confirmation" implies unreserved acceptance of these general conditions of sale, which prevail over all previous or specific versions generated by the buyer, including email exchanges.

Orders

PRODUCT OFFERING

If the requested transaction with the payment card has been authorized, the order is processed on the working day following the day the payment was successful. All information about product offers, presented on this website in the E-Commerce section, is valid within the limits of available stock and subject to supplier availability. Products are presented as accurately as possible. The price of each product is indicated, as well as the weight of each purchasable unit. In the case of tiles, SPC, and parquet, both the price per "square meter" and the price per box are shown. In the case of shower enclosures and sanitary ware, the price per "each" unit is shown without a unit of measure.

ORDER ACCEPTANCE

The order remains binding for the buyer from the moment of "Order Confirmation."

ORDER CANCELLATION

If Pernigotto srl does not receive payment within 7 days from the time of the order, the order is considered canceled.

Price and Payment

PRODUCT PRICE

Product prices are indicated in euros, including VAT. The prices displayed on this website are valid exclusively for online purchases and may differ from those applied at the Pernigotto s.r.l – Castellanza (VA) showroom.

DELIVERY CHARGES

The transport cost will be calculated automatically based on the weight of the items in the order and the destination location. In any case, the shipping cost amount is shown in the final summary, BEFORE the actual completion of the purchase procedure.

PAYMENT

Payment must be made simultaneously with the order via bank transfer, credit card, or PayPal account.

Delivery and Returns

DELIVERY METHODS

Delivery times for goods are purely indicative and not binding for the Supplier. Any delays do not entitle the Customer to request compensation for damages, much less to delay payments.

If delivery should be temporarily impossible due to circumstances beyond the Supplier's control (strikes, fires, wars, pandemics, floods, lack or scarcity of raw materials, breakdowns in production plants), the original delivery period will be automatically extended by a period equal to the duration of the impediment.

Pernigotto s.r.l operates with a "just in time" method, meaning that every item purchased by the customer on cegoceramiche.com will be processed with the manufacturing/supply company as soon as possible, and in any case, the day after receiving payment. Items on cegoceramiche.com are therefore not in stock and not available for immediate delivery unless expressly indicated with the words "item available" or present in the "stock" section.

All customers are invited, before placing a particularly urgent order, to send an email to cegoceramiche@pernigotto.com asking for availability and any delivery times, which will vary depending on the product to be purchased.

If one or more products in the order are not immediately available, the order, even if paid, will be processed when all goods are available. However, Pernigotto s.r.l staff will inform the customer about any delays in delivery times. In any case, Pernigotto s.r.l cannot guarantee that any reorders of out-of-stock batches can be processed, in which case it will notify the consumer and will refund the sums already paid, in the forms and methods referred to in art. 6 n.2 of Legislative Decree no. 185/1999.

RECEIPT AND COMPLAINTS

Upon delivery, the buyer must carry out all necessary inspections to detect any damage, missing packages, defects, or other apparent flaws or non-conformities of the delivered products with their order. The buyer must specifically verify that the number of packages corresponds to that indicated on the delivery note and the condition of the packaging, which must be intact. At the time of delivery, the buyer must sign ''with reservation for inspection''. If there is clearly visible damage to the outer packaging, the buyer must add details of the damage to the reservation for inspection.

  • DISPUTES: ANY DAMAGED MATERIAL RECEIVED MUST BE REPORTED VIA EMAIL, ATTACHING PHOTOS OF THE MATERIAL STILL ON THE PALLET AND NOT UNPACKED, WITHIN AND NO LATER THAN 5 CALENDAR DAYS FROM THE MOMENT OF DELIVERY.

Requests for replacement and/or refund that do not meet these requirements will not be processed.

LIABILITY

Pernigotto srl assumes no responsibility for disruptions attributable to force majeure such as accidents, explosions, fires, riots, strikes and/or lockouts, earthquakes, floods, damage to computer systems, system failures, and other similar events that prevent, in whole or in part, the execution of the contract within the agreed times. Pernigotto srl will not be liable for any damages, losses and/or costs incurred as a result of the non-execution of the contract for the causes mentioned above, the consumer being entitled only to the return of the price paid. Similarly, Pernigotto srl is not responsible for any fraudulent and unlawful use of credit cards, checks, and other means of payment. Pernigotto srl, in fact, at no time during the purchase procedure is able to know the consumer's credit card number, which, through a secure connection, is transmitted directly to the bank managing the service.

Product Warranty

WARRANTY

Pernigotto s.r.l markets high-quality products, for which any legal warranty is directly provided by the manufacturers, and the reference regulations as well as the warranty application procedures will be those indicated and highlighted by the manufacturer together with the product.

LEGAL GUARANTEES

Products are guaranteed against any defects of conformity and hidden defects according to the conditions provided by the provisions of the Consumer Code and the Civil Code. Extracts from the Consumer Code:

Art. L. 211-4. The seller is obliged to deliver goods that conform to the contract and is liable for any conformity defects existing at the time of delivery. Similarly, the seller is liable for conformity defects resulting from packaging, assembly instructions, or installation if it is the seller's responsibility under the contract, or if it was carried out under the seller's responsibility.

Art. L. 211-5. To be in conformity with the contract, the goods must: 1. Be fit for the purpose normally intended for similar goods and, where applicable: correspond to the description given by the seller and possess the qualities that the seller has presented to the buyer in the form of a sample or model; present the qualities that a buyer can legitimately expect with regard to the public statements made by the seller, the producer or their representative, in particular in advertising or labeling; 2. Or present the characteristics defined by mutual agreement between the parties, or be intended for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter.

Art. L. 211-12. The action resulting from a defect of conformity is time-barred after two years from the date of delivery of the goods.

Right of Withdrawal

Consumer's Right of Withdrawal

The sale of products via the Internet is governed by Legislative Decree no. 206/05 (articles 50 to 68) which regulates distance contracts, i.e., those concluded outside commercial premises. This legislation establishes the right of withdrawal, which is the possibility for the consumer to return the purchased product and obtain a refund of the expenses incurred, excluding outbound and return shipping costs. This right is reserved exclusively for natural persons (consumers), and therefore cannot be exercised by legal entities and natural persons acting for purposes related to their professional activity. To exercise the right of withdrawal, it is necessary to send, within 14 working days of receiving the goods, a communication expressing the desire to withdraw from the contract. The costs of returning the product are borne by the consumer.

The right of withdrawal is completely forfeited if the returned product is not intact, i.e.:

  • lack of original packaging or unsuitable packaging;
  • the product has been installed;
  • absence of integral elements of the product (accessories, screws, components, etc.);
  • damage to the product for reasons other than transport.

PROCEDURE FOR EXERCISING THE RIGHT OF WITHDRAWAL

If – having made a purchase on our website cegoceramiche.com – you wish to withdraw from the purchase, you will need to follow this simple procedure:

Send a communication to Pernigotto s.r.l, within 14 days of receiving the goods, via e-mail to cegoceramiche@pernigotto.com.

Arrange, using a courier of your choice, for the shipment of the product carefully packaged in its original packaging and complete with all accessories, instruction manuals, and everything originally contained therein.

Insure the shipment against theft and transport damage and bear the related costs. If the returned product has not been insured for the value indicated on the invoice, in the event of damage or loss occurring during transport, Pernigotto srl reserves the right to charge for any damages incurred by withholding them from the amounts to be refunded.

Pernigotto srl will proceed, by bank transfer, to refund only the cost of the goods shipped within 14 working days following the return of the goods and in any case not before receiving the goods. We therefore invite you to indicate your bank details and include this information with the returned goods.

Return Conditions

The shipping costs for returns are always borne by the customer, who can return any item (with the exception of personalized products such as shower enclosures, shower trays, interior doors, or easily perishable items) in substantially intact condition and properly franked.

Pernigotto srl will bear all costs in the case of defective or broken items delivered.

Should the order not be delivered within the foreseen terms due to causes not attributable to us (e.g. incorrect address provided), the redelivery costs and storage costs, which will be calculated on a case-by-case basis, will be borne by the customer.

The purchase contract is automatically canceled when the return arrives at its destination, and the customer will be refunded within 14 days. If the customer has made payment via bank transfer, their bank details will be requested to process the refund.

COMPETENT COURT

For any eventual dispute between the Parties, the exclusive jurisdiction of the Court of Busto Arsizio (VA) is established and accepted.
