General conditions

These general conditions of sale apply to any order placed on the Pernigotto srl website www.cegoceramiche.com

The "Order Confirmation" by the buyer implies the unreserved acceptance of these general conditions of sale which prevail over all previous or specific versions generated by the buyer, including the exchange of e-mail.

Orders

PRODUCT OFFER

In the event that the requested payment card transaction has been authorised, the order will be processed on the working day following the day on which the payment was successful. All information regarding Product offers, presented on this Site in the E-Commerce section, is valid within the limit of available stocks and subject to availability from suppliers. The products are presented as precisely as possible. For each product, the price and weight of each unit that can be purchased are indicated. In the case of tiles, spc, parquet, both the price per "square meter" and the price per box are shown. In the case of shower cubicles and sanitary fixtures, the price per unit "each" is shown without units of measurement.

ACCEPTANCE OF THE ORDER

The order remains firm for the buyer from the moment of "Order Confirmation".

CANCELLATION OF THE ORDER

If after 7 days from the time of the order Pernigotto srl does not receive payment, the order will be considered cancelled.

Price and payment

PRICE OF PRODUCTS

The prices of the Products are indicated in euros, including VAT. The prices displayed on this site are valid exclusively for online purchases and may differ from those charged at the Pernigotto srl showroom – Castellanza (VA).

DELIVERY COSTS

The transport cost will be automatically calculated based on the weight of the items making up the order and the destination location. In any case, the amount of shipping costs is reported in the final summary, BEFORE the actual conclusion of the purchase procedure.

PAYMENT

Payment must be made at the same time as the order via bank transfer, credit card or PayPal account.

Delivery and returns

DELIVERY METHODS

The delivery terms of the goods are purely indicative and not binding for the Supplier. Any delays do not entitle the Customer to request any compensation for damages, much less delay payments.

If delivery is temporarily impossible due to reasons beyond the Supplier's control (strikes, fires, wars, pandemics, floods, lack or scarcity of raw materials, failures in production plants), the deadline originally indicated for delivery will be automatically extended. for a period equal to the duration of the impediment.

Pernigotto srl works with a "just in time" method, that is, each item that the customer purchases on the cegoceramiche.com website will be shipped to the manufacturing/supplier company as soon as possible and in any case the day after receiving payment. The items on cegoceramiche.com are therefore not in stock and not ready for delivery unless expressly indicated with the words "item available" or present in the "stock" section.

All customers are invited, before placing a particularly urgent order, to send an email to cegoceramiche @pernigotto.com asking for availability and any delivery times, which will vary depending on the product to be purchased.

In the event that one or more products in the order are not immediately available, the order, even if paid for, will be processed when all the goods are available. However, it will be the responsibility of the Pernigotto srl staff to inform the customer of any delays in delivery times. In any case, Pernigotto srl is not able to guarantee that any reorders of sold out lots can be processed, in which case it will notify the consumer and will refund the sums already paid, in the forms and methods set out in the art. 6 n.2 of the Legislative Decree. No. 185/1999.

RECEPTION AND COMPLAINTS

The buyer must proceed, at the time of delivery, with all the necessary inspections to detect any damage, missing packages, defects or other apparent defects or non-conformity of the products delivered with his order. In this case, the buyer must verify that the number of packages corresponds to that indicated on the delivery note and the condition of the packaging, which must be intact. At the time of delivery the buyer must sign ''subject to inspection''. If there is clearly visible damage from the external packaging, the buyer must add details of what is damaged to the inspection reserve.

- COMPLAINTS: ANY DAMAGED MATERIAL RECEIVED MUST BE REPORTED VIA EMAIL, ATTACHING PHOTOS OF THE MATERIAL STILL ON THE PALLET AND NOT UNBACKLED, WITHIN AND NO LATER THAN 6 CALENDAR DAYS FROM THE MOMENT OF DELIVERY.

Replacement and/or refund requests that do not comply with these requirements will not be accepted.

RESPONSIBILITY '

Pernigotto srl assumes no responsibility for disservices attributable to force majeure such as accidents, explosions, fires, riots, strikes and/or lockouts, earthquakes, floods, damage to IT systems, system failures, and other similar events that prevent, in whole or in part, to execute the contract within the agreed times. Pernigotto srl will not be responsible for any damages, losses and/or costs suffered following failure to execute the contract for the above-mentioned causes, the consumer having the right only to a refund of the price paid. Likewise, Pernigotto srl is not responsible for any fraudulent or illicit use of credit cards, checks and other means of payment. In fact, at no time during the purchase procedure is Pernigotto srl able to know the consumer's credit card number which, via a secure connection, is transmitted directly to the bank managing the service.

WARRANTY

Pernigotto srl markets products of a high quality level, for which any guarantee required by law is directly provided by the manufacturing companies and the reference legislation as well as the methods of application of the guarantee will be those indicated and highlighted by the manufacturer together with the product.

LEGAL GUARANTEES

The products are guaranteed against any defects of conformity and hidden defects according to the conditions established by the provisions of the Consumer Code and the Civil Code. Extracts from the Consumer Code:

Article L. 211-4. The seller is required to deliver goods that conform to the contract and is liable for any defects in conformity existing at the time of delivery. Likewise, he is liable for defects of conformity resulting from the packaging, assembly instructions or installation if it is his responsibility under the contract, or was carried out under his responsibility.

Article L. 211-5. To comply with the contract, the good must: 1. Be suitable for the use normally expected for a similar good and, as the case may be: correspond to the description given by the seller and possess the qualities that it presented to the buyer in the form of sample or model; present the qualities that a buyer can legitimately expect in relation to public declarations made by the seller, the manufacturer or his representative, in this case in advertising or labelling; 2. Or have the characteristics defined by mutual agreement between the parties, or be intended for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter.

Article L. 211-12. The action resulting from the lack of conformity is barred for two years starting from the date of delivery of the goods.

Right of withdrawal

Consumer right of withdrawal

Sales of products via the Internet are governed by Legislative Decree no. 206/05 (articles 50 to 68) which regulates the matter of distance contracts, i.e. carried out outside commercial premises. This legislation establishes the right of withdrawal, i.e. the possibility for the consumer to return the purchased product and obtain reimbursement of the expense incurred excluding the return shipping costs. This right is reserved exclusively for natural persons (consumers), therefore it cannot be exercised by legal persons and natural persons acting for purposes relating to any professional activity carried out. To exercise the right of withdrawal it is necessary to send, within 14 working days of receipt of the goods, a communication in which the intention to withdraw from the contract is expressed. The costs of returning the product are borne by the consumer.

The right of withdrawal is totally lost if the returned product is not intact, that is:

  • lack of original packaging or inappropriate packaging;
  • the product has been installed;
  • absence of integral elements of the product (accessories, screws, components, etc.);
  • damage to the product due to causes other than transport.

PROCEDURE FOR THE EXERCISE OF THE RIGHT OF WITHDRAWAL

If - having made a purchase on our website cegoceramiche.com - you want to withdraw from the purchase, you will need to follow this simple procedure:

Send Pernigotto srl, within 14 days of receiving the goods, a communication via e-mail to cegoceramiche@pernigotto.com.

Using a courier of your choice, arrange for the product to be shipped carefully packaged in the original packaging and complete with all accessories, instruction manuals and everything originally contained.

Insure the shipment against theft and transport damage and bear the related costs. If the returned product has not been insured for the value indicated on the invoice, in the event of damage or loss during transport, Pernigotto srl reserves the right to charge for any damage suffered by deducting it from the sums to be refunded.

Pernigotto srl will proceed, by bank transfer, with a refund relating only to the cost of the goods shipped within 14 working days following the return of the goods and in any case not before receiving the goods. We therefore ask you to indicate your bank details and include this information together with the returned goods.

Return conditions

The shipping costs for returns are always paid by the customer who can return any item (with the exception of personalized products such as shower cubicles, shower trays, internal doors, or easily perishable items) in substantially intact conditions and correctly postage-paid.

Pernigotto srl will bear all costs in the event of defective or broken items delivered.

In the event that the order is not delivered within the expected deadlines for reasons not attributable to us (e.g. the address provided is incorrect), the customer will be responsible for the redelivery costs and storage costs, which will be calculated from time to time. .

The purchase contract is automatically canceled when the return arrives at its destination and the customer will be refunded within 14 days. If the customer made the payment by bank transfer, his bank details will be requested in order to make the refund.

JURISDICTION

For any possible dispute between the Parties, the exclusive jurisdiction of the Court of Busto Arsizio (VA) is established and accepted.
